SameSide Terms of Use

Who we are

SameSide is published by DT Nova Tmi, a sole trader registered in Finland, trading as The Dolce Way. These terms are an agreement between you and DT Nova Tmi, not Apple.

What SameSide is

SameSide gives separated parents a shared space for each child: a custody calendar, messaging with a permanent record, a child info hub, a photo feed, and, with a paid subscription, an expense log, a journal and PDF export.

The free tier includes the custody calendar, messaging, the child info hub and a photo feed of up to 50 photos per child. It stays free.

Your license to use the app

We grant you a personal, non-exclusive, non-transferable license to use SameSide on Apple devices you own or control, for managing the care of children you are responsible for or have been invited to. You may not copy, sell, rent, reverse engineer or redistribute the app, or use it to build a competing service.

SameSide Plus subscriptions

SameSide Plus is an optional auto-renewable subscription sold through Apple's in-app purchase system and charged to your App Store account.

• Priced per child. Each subscription unlocks SameSide Plus for one child's space. It covers every member of that space: both parents, stepparents, grandparents and anyone else invited. Other members are never charged for that child.
• Plans. Monthly at EUR 6.99 with a 7-day free trial, or yearly at EUR 49.99 with a 14-day free trial, per child. Prices may vary by region and are always shown in the App Store before you buy.
• Free trial. A trial converts to a paid subscription unless you cancel at least 24 hours before it ends. Any unused trial time is forfeited when you start a paid period. One trial per plan per Apple account.
• Renewal. The subscription renews automatically and your account is charged within 24 hours before the current period ends, unless you cancel at least 24 hours before that.
• Cancelling. Cancel anytime in your App Store account settings (Settings > your name > Subscriptions on your iPhone). Deleting the app does not cancel a subscription. After cancellation you keep Plus until the end of the period already paid for; your data is not deleted, the space simply returns to the free tier and its limits.
• Refunds. Purchases are processed by Apple, so refunds are handled by Apple under its own terms, at reportaproblem.apple.com.

We never sell lifetime unlocks, and we never charge the second parent to join a space.

Your content

The messages, photos, calendar entries, expenses, journal entries and child information you add belong to you. You grant DT Nova Tmi a limited license to store, process and transmit that content only as needed to run the service: syncing it between the members of the child's space and generating the exports you request. We do not use your content for advertising, do not sell it, and do not train AI models on it.

You are responsible for the content you add and for having the right to share it, including photos of your child, with the other members of the space.

The message record

Messages in SameSide cannot be edited or deleted after sending, and every message and journal entry carries a server timestamp. This permanence is a core feature, not a defect: it keeps the record honest for both parents. Send accordingly.

Exports are timestamped and carry a record digest: every message is hashed together with the one before it, so the digest at the foot of the file covers each message, its author, its text and its server timestamp, in order. Change one character and the digest no longer matches. You can recompute it at any time from Messages, using Verify this record, and compare the two. That shows the file matches what SameSide holds; it cannot prove anything about SameSide itself, and we do not claim otherwise. Whether any record is admissible or given weight in a legal proceeding is always for the court and the law of your jurisdiction to decide; we make no promises about it. SameSide is not legal advice and is not a substitute for a lawyer, mediator or child welfare authority.

Acceptable use

You agree not to use SameSide to:

• Harass, threaten or abuse the other parent or anyone else
• Break the law, a court order or a custody agreement
• Upload unlawful content or content that harms a child
• Impersonate another person or access a space you were not invited to
• Probe, overload or interfere with the service or its security

We may suspend or close accounts that do these things. Report them from Settings, or by long-pressing the message itself. Because the message record is permanent, suspension never erases what was written, and reporting is not a way to have a message removed. If you want the messages to stop entirely, you can leave the child's space from Settings.

Your account, leaving and deletion

You sign in with Sign in with Apple. You can export your data, leave any child's space, and delete your account, all from Settings in the app. Deleting your account removes your profile and your access; because the space is shared, the messages you sent remain visible to its other members as part of the shared record. When a child's space has no members left, its content is deleted. Details are in the SameSide privacy policy.

Warranty and liability

SameSide is provided as is. We work to keep it available, accurate and backed up, but we do not warrant uninterrupted or error-free operation, and you should not treat it as your only copy of anything critical.

To the extent permitted by law, DT Nova Tmi is not liable for indirect or consequential damages, and our total liability under these terms is limited to the amount you paid for SameSide Plus in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited under Finnish law, or the statutory rights you have as a consumer under the mandatory law of the country where you live.

Apple's role

Apple is not a party to these terms and has no obligation to provide support or maintenance for SameSide. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Where these terms are silent, Apple's standard Licensed Application End User License Agreement applies.

Changes to these terms

If we change these terms in a way that matters, we will update this page and tell you in the app before the change applies to you. Continuing to use SameSide after that means you accept the new terms. The date at the top shows the current version.

Governing law and disputes

These terms are governed by the law of Finland, without depriving you of the protection of mandatory consumer law in your country of residence. Disputes are heard by the Finnish courts, or by the competent court of your home country where consumer law so provides. Consumers in Finland can also turn to the Consumer Disputes Board (kuluttajariitalautakunta, kuluttajariita.fi) after contacting Consumer Advisory Services.
